TERMS AND CONDITIONS OF USE FOR BC Game

USE OF MATERIALSYou may access, view, and use Materials from this Site solely for personal, non-commercial purposes. You shall not reproduce, modify, create derivative works of, distribute, display, or perform the content in whole or part without express written permission from BC Game.
WARRANTY DISCLAIMERBC Game disclaims any warranties with respect to the accuracy, completeness, reliability, timeliness, or suitability of Materials for any particular purpose, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
LIMITATION OF LIABILITYBC Game shall not be liable under contract, tort, or other theories of liability for:

a) Any incidental, consequential, special, or punitive damages resulting from the use of this Site; or

b) The cost of procurement of substitute goods or services; or

c) Loss of use of any equipment, data, or software.

LIMITATION OF LIABILITY (CONT'D)BC Game's aggregate liability for all claims arising in connection with your access to and use of the site shall be limited to:

a) An amount equal to ten times the total amount wagered by you on games or contests offered through the Site during a calendar month; or

b) The actual damages sustained by You, whichever is less.

INDEMNIFICATIONYou agree to indemnify and hold harmless BC Game and its officers, directors, employees, affiliates, agents, contractors, successors, assigns, partners, licensees, franchisees, sponsors, suppliers, consultants, experts, advisors, predecessors, successors-in-interest, heirs, executors, administrators, and beneficiaries from any claims, demands, actions, or causes of action that may arise:

a) From your breach of these Terms and Conditions; or

b) In connection with any warranty claim brought against You.

DISPUTE RESOLUTIONAny disputes arising out of or related to these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules then prevailing, provided such arbitration takes place within a court having jurisdiction over BC Game's principal place of business.
GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws. You agree to submit to the exclusive jurisdiction of the courts located therein for any disputes arising out of or related to these Terms and Conditions.

AMENDMENTS TO TERMSBC Game reserves the right, at its sole discretion, to modify or change all or any part of these Terms and Conditions without notice to you.
EFFECT OF CHANGESYour continued use of this Site after such changes have been made shall constitute your acceptance of these modified terms and conditions.
SEVERABILITY

If any term or provision hereof is held by a court to be invalid, illegal, or unenforceable in whole or in part, the remaining provisions hereto shall continue to be valid and binding upon you.

HEADINGSHeadings used in these Terms and Conditions are for convenience only and shall not affect their interpretation.
COMPLETE AGREEMENT

These Terms and Conditions contain the entire agreement between BC Game and You with respect to your access to, use of, or participation on this Site.

NO WAIVER

BC Game's failure to enforce any term or provision hereof at any time shall not constitute a waiver thereof.

ENFORCEABILITYIn addition to any other remedies available under the laws, you agree that BC Game may seek injunctive relief (as well as such other equitable or declaratory relief) without prejudice to its right to proceed with any other remedy and/or in seeking any form of damages.
